Terms of sale

Courtesy translation: the French version prevails. These terms and conditions of sale govern distance sales made on the swf-wakeboarding.fr website between the Seller and its consumer customers.
1. Seller identification
The products shown on the swf-wakeboarding.fr website are sold by Gauthier Etaix, Sole trader (entrepreneur individuel), registered with the RCS Rennes 890 750 748 (registered trade name: “BPM”), who operates the SWF brand and website (the “Seller”).

The “Customer” (or “you”) is any individual who places an order on the website for purposes outside their trade, business, craft or profession.
2. Scope and acceptance
These terms and conditions of sale (the “Terms”) apply to every order for products placed on the website by a consumer. Together with the product pages and the information displayed before payment, they constitute the pre-contractual information required by article L221-5 of the French Consumer Code.
To order, you must have the legal capacity to enter into a contract. You accept the Terms by ticking the box provided before payment. The Terms in force on the date of the order apply.
Please read the Terms before ordering and print or save a copy.
3. Products
The Seller offers SWF-branded t-shirts. The main characteristics of each product (model, colour, available sizes, description) are given on its product page, which you are invited to read before ordering. These products are the brand's own designs: they are not customised at the Customer's request.
Products are made and shipped by our manufacturing and shipping partners, in particular our logistics partner Printful.
Photographs and colours shown on screen are indicative: colours may vary depending on your screen. The size guide gives, for each product, garment measurements taken flat (±2 cm tolerance).
4. Prices
Prices are shown in euros. VAT not applicable (French Tax Code, art. 293 B).
Shipping costs are a flat fee (€4.90) shown in the cart before you confirm your order. The total price to pay, delivery included, is displayed before payment. No hidden fees are charged.
The Seller may change its prices at any time. The price that applies to your order is the one displayed when you place it.
For security reasons, the value of an order is capped at €500 and the quantity of any one item (model, colour and size) is capped at 10 per order.
5. Ordering process and formation of the contract
You place an order by following the steps below:
- Selection: choose the product, size and colour and add them to your cart.
- Cart review: check the contents, quantities, prices and shipping costs. You can change or remove items before continuing.
- Acceptance of the Terms: tick the box stating that you have read and accept the Terms.
- Order and payment: click “Order and pay” (order with obligation to pay). You are redirected to Stripe's secure payment page, where you enter your delivery address, email address and payment method. You can check and correct your details there before paying.
- Confirmation: the order is binding once payment is completed. You are given an order number in the format SWF-XXXXXXXX and a confirmation email is sent to you.
The contract is formed when payment is completed. No contract is formed until payment has been successfully processed.
The Seller may refuse or cancel an order for a legitimate reason (declined or incomplete payment, suspected fraud, abnormal request, ongoing dispute with the Customer, address outside the delivery area). If you have already paid, you are then refunded in full.
6. Secure payment
Payment is made in euros, in full, at the time of the order, on the payment page hosted by Stripe Payments Europe Ltd (Ireland). Accepted payment methods are those shown on the payment page (bank cards and, depending on your device, Apple Pay or Google Pay). Your bank may ask you to complete strong authentication (3-D Secure).
The website never sees or stores your card numbers: they are processed exclusively by Stripe.
The Seller reserves the right to suspend or cancel any order in case of suspected fraud or unauthorised use of a payment method. You may request an invoice by email, quoting your order number.
7. Availability
Products are offered subject to availability. If an ordered product turns out to be unavailable after your order, the Seller informs you by email and refunds you in full (delivery costs included), without undue delay and at the latest within fourteen days.
8. Delivery
- Delivery area: Orders are delivered in France only. No delivery is made to any other country.
- Address: delivery is made to the address you entered at payment. You are responsible for its accuracy; if the address is wrong or incomplete, re-shipping costs may remain at your charge.
- Costs: flat fee of €4.90, shown before payment.
- Estimated times: production and preparation of 2–5 business days, then delivery of 1–8 business days, i.e. about 3–13 business days in total. These times are non-binding estimates and may vary (busy periods, public holidays, carrier). If no date or time limit has been agreed, the Seller delivers at the latest thirty days after the contract is formed (article L216-1 of the French Consumer Code).
- Tracking: a tracking number is sent to you by email as soon as the order ships, where the carrier provides one.
Late delivery. If delivery has not taken place within the applicable time, you may request the Seller to deliver within an additional reasonable period and, failing that, terminate the contract under articles L216-1 et seq. of the French Consumer Code. Please contact us, quoting your order number.
On receipt. Check the condition of the parcel. If it is damaged, opened or incomplete, state precise reservations to the carrier on delivery (or as soon as possible) and contact us promptly with your order number and photographs. If your parcel has not arrived once the estimated time has elapsed, please also contact us.
9. Retention of title and transfer of risk
The products remain the Seller's property until the price has been paid in full.
In accordance with the French Consumer Code, the risk of loss or damage to the products passes to the Customer when the Customer, or a third party designated by the Customer (other than the carrier), takes physical possession of them.
10. Right of withdrawal
Period. Under articles L221-18 et seq. of the French Consumer Code, you have fourteen (14) days to exercise your right of withdrawal, without giving any reason and without penalty. The period starts when you, or a third party you designated (other than the carrier), receive the parcel. If your order contains several items delivered separately, it starts when the last item is received. You may exercise this right as soon as the contract is formed.
The products on the website are the brand's own designs and are not customised at the Customer's request: the right of withdrawal applies to all orders.
How to withdraw. Before the period expires, by any of the following means:
- online, using the website's withdrawal function, available in two clicks and without a customer account on the Withdraw page (“Withdraw here” button, then “Confirm withdrawal”). An acknowledgement showing the date and time of your request is sent to you by email;
- by email to swf.serviceclient@gmail.com, quoting your order number;
- using the model withdrawal form reproduced in the appendix or any other unequivocal statement.
Returning the products. Once you have notified your withdrawal, the return address is sent to you by email. You must send back or hand over the products no later than fourteen (14) days after communicating your decision. The direct cost of returning the products is at your charge (article L221-23 of the French Consumer Code), except for defective or non-conforming products. We recommend a tracked shipment and keeping proof of dispatch.
You may try the product on to check its nature, characteristics and size. You are liable only for any diminished value of the products resulting from handling other than what is necessary for those checks (article L221-23 of the French Consumer Code); the amount of that diminished value may then be deducted from the refund.
Refund. The Seller refunds all sums paid, including the initial standard delivery costs, without undue delay and at the latest within fourteen (14) days of the date on which it is informed of your decision to withdraw (article L221-24 of the French Consumer Code). It may postpone the refund until it has received the products or until you provide proof of dispatch, whichever is earlier. The refund is made using the same payment method as for the order, at no cost to you.
11. Legal guarantees
The Seller is bound by the legal guarantee of conformity and the guarantee against hidden defects, regardless of any commercial guarantee. Reminder of the applicable legal provisions:
Legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code). The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at delivery and appearing within two years of delivery. During the twenty-four months following delivery, you do not have to prove that the defect exists: it is presumed to have existed at the time of delivery. In case of lack of conformity, you are entitled to have the goods brought into conformity by repair or replacement, subject to the conditions set out in the French Consumer Code; failing that, you may obtain a price reduction or termination of the contract. You may choose to rely on the guarantee of conformity or on the guarantee against hidden defects.
Guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). The seller is liable for hidden defects in the item sold that make it unfit for its intended use, or that so reduce that use that the buyer would not have bought it, or would have paid a lower price, had they known of them. Any claim must be brought within two years of discovering the defect. You may choose between cancelling the sale and a price reduction.
Printing or manufacturing defect. Email us at swf.serviceclient@gmail.com, quoting your order number and attaching one or more photographs of the defect. We will then tell you what to do.
12. Customer service and complaints

13. Personal data
The Seller processes your personal data to fulfil your order and answer your requests. Information on the data collected, purposes, retention periods, recipients and your rights is set out in the privacy policy. To exercise your rights: swf.serviceclient@gmail.com.
14. Intellectual property
The SWF brand, logos, visuals, photographs, designs and texts on the website and on the products are protected. Your purchase does not give you any intellectual property right: you may use the product you bought for personal purposes, but any reproduction, representation or exploitation of the designs, in whole or in part, without the Seller's prior written consent is prohibited.
15. Force majeure
The Seller is not liable for any failure to perform its obligations caused by force majeure within the meaning of article 1218 of the French Civil Code (for example a strike, a disaster or a disruption of transport or communication networks). Performance of the contract is suspended for the duration of the event. If the impediment is permanent, the contract is terminated and you are refunded the sums paid.
16. Severability and non-waiver
If any provision of the Terms is held void or unenforceable, the remaining provisions stay in force. The Seller's failure to rely on a breach by the Customer is not a waiver of the right to rely on it later.
17. Language
The Terms are written in French. This English translation is provided as a courtesy and for information only: in case of discrepancy, the French version prevails.
18. Governing law and jurisdiction
The Terms are governed by French law. If you live in the European Union, you keep the benefit of the mandatory consumer protection provisions of your country of residence.
In case of dispute, please contact us first to seek an amicable solution. Failing that, under article R631-3 of the French Consumer Code, you may bring proceedings, at your choice, before one of the courts with territorial jurisdiction under the French Code of Civil Procedure or before the court of the place where you lived when the contract was formed or when the harmful event occurred.
19. Retention of orders
The Seller keeps the documents relating to your orders for ten years, in accordance with article L123-22 of the French Commercial Code. You may request a copy by email, quoting your order number.
20. Changes to the Terms
The Seller may change the Terms at any time. Your order remains subject to the Terms in force on the date it was placed. Last updated: 5 October 2026.
Appendix: model withdrawal form
Model provided in the annex to article R221-1 of the French Consumer Code. Complete and return this form only if you wish to withdraw from the contract. You can also use the online withdrawal function.
