Terms of use
Last updated:
Courtesy translation: the French version prevails. These terms of use (the “Terms of Use”) govern access to and use of the swf-wakeboarding.fr website. Purchases are also governed by the terms of sale.
1. Purpose
The swf-wakeboarding.fr website presents the SWF brand and its products and allows you to order them. The Terms of Use set the rules for accessing the website and using its content. By browsing the website you accept the Terms of Use; if you do not accept them, please do not use the website.
The website is published by Gauthier Etaix (the “Seller”). Full details are in the legal notice.
2. Access to the website
Access to the website is free and open to anyone with an internet connection. Connection and equipment costs are at your own expense. No customer account is needed to browse the website or place an order.
The Seller endeavours to keep the website accessible but does not guarantee continuous availability: access may be suspended or limited for maintenance, security or update reasons, or because of events beyond its control.
3. Intellectual property
The SWF brand, logos, visuals, photographs, graphic designs, texts, structure and code of the website are protected by intellectual property law and belong to the Seller or are used with their owners' permission.
You may browse the website and use it strictly for personal purposes. Any reproduction, representation, modification, extraction or exploitation, in whole or in part, of the brand, visuals or website content, by any means, without the Seller's prior written consent is prohibited and may constitute infringement.
4. Prohibited conduct
In particular, you must not:
- extract or copy the website content by abusive automated means (scraping), in particular to build a database or a competing website;
- run load tests, attacks or any action intended to disrupt the website or the third-party services connected to it;
- bypass or attempt to bypass the website's security and protection measures (rate limiting, anti-abuse checks, price or stock checks);
- place fake orders, use a payment method that is not yours or attempt fraud;
- impersonate another person or submit, through the forms, content that is unlawful, abusive, defamatory or infringes third-party rights.
The Seller may restrict access to the website, cancel an order or take any appropriate action in case of breach, without prejudice to its other rights.
5. External links
The website may contain links to third-party websites (for example the brand's social networks). The Seller has no control over those websites and is not responsible for their content, practices or availability. Their use is subject to their own terms.
Linking to the website is free, provided that it does not harm the brand's image and does not cause confusion as to the origin of the content.
6. Liability
The Seller takes great care over the website's content but cannot guarantee that it is free from errors or omissions. The website is provided on a best-efforts basis: the Seller does not guarantee that it will be free from interruption, bugs or errors, or from viruses or harmful elements.
To the extent permitted by law, the Seller is not liable for indirect damage resulting from use of the website or inability to access it. These limitations do not affect the rights the French Consumer Code gives consumers, in particular regarding legal guarantees (see the terms of sale), nor do they apply in case of gross negligence, wilful misconduct or personal injury.
7. Reporting unlawful content
If you notice manifestly unlawful content on the website or an infringement of your rights, you can report it by email to swf.serviceclient@gmail.com, stating your identity, the precise location of the content (page address) and why you consider it unlawful. The Seller reviews reports promptly and takes the necessary measures where appropriate.
8. Personal data and cookies
The processing of your personal data is described in the privacy policy and the use of trackers in the cookie policy.
9. Governing law and disputes
The Terms of Use are governed by French law. In case of dispute, please contact us first to seek an amicable solution. If you are a consumer, you may bring proceedings, at your choice, before one of the courts with territorial jurisdiction or before the court of the place where you live, in accordance with article R631-3 of the French Consumer Code, and you keep the benefit of the mandatory consumer protection provisions of your country of residence.
10. Changes to the Terms of Use
The Seller may change the Terms of Use at any time; the applicable version is the one published on the website on the date you visit it. Last updated: 5 October 2026.
